I ordered a free trial of an eye cream for which only shipping and handling coverage was required. The terms and conditions that were presented to me were:
"When You purchase the Lumineux Trial Offer You automatically accept the following terms and conditions.
We are confident you will see the benefits of using our Garcinia Health Product within our 14 day trial. You are taking the next step toward a more confident you! Upon signing up for your trial offer, your credit card provided will be charged a One-time Shipping & Handling fee of $5.95."
After two weeks, my card was charged for $88.97 and $89.97. I went to their website to call them and ask what was going on. That is when I noticed that the Terms and Conditions on their website were much, much longer than the Terms and Conditions I was presented, and include a clause stating the following:
" If you contact customer service to terminate your trial enrollment within 14 day of the date that you enroll in the Program, you will not receive any additional product and you will not be charged anything else. Your enrollment date is the date that you submit your order for the trial product. All orders are shipped within two business days. If you do not cancel within 14 day of the date that you enroll in the Program, we will charge the same card you provided at enrollment the monthly membership fee of $89.99. Then, beginning about 30 days after enrollment in membership program we will send you a fresh monthly shipment of the product and charge your card $89.99 when each supply ships. You can cancel monthly shipments and avoid further Monthly Charges at any time by contacting customer service 24 hours a day, 7 days a week, at 877-302-5407."
This was NOT something that I was presented upon purchase.
When I called the number they provided, 877-302-5407, a man named Michael picked up and I said that I wanted to cancel the membership, and he said that they do not carry the product under any of the names I listed (Lumineux, Aimsley Eye Serum). He asked me for the first 6 and last 4 numbers on my card, which I refused to provide. I said that I did not call for the product but to cancel the membership that I was charged for but did not actually sign up for. After which he quickly said that I had called the wrong number and "Thank you for calling customer support and have a great day" and promptly hung up.
